Terms of Service
Welcome to Memento: Daily Death Reminder. These Terms of Service ("Terms") govern your access to and use of the Memento: Daily Death Reminder mobile application (the "App") provided by FATIH CICEK ("we", "us", or "our"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.
1. Who may use the App
The App is intended for users who are at least 13 years old. If you are under the age required in your country to form a binding contract, you must have the consent of a parent or legal guardian to use the App.
2. License to use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App solely for your personal, non-commercial use on a compatible iOS device.
3. In-app purchases and subscriptions
Some features of the App may require payment or a subscription. Payments are handled by Apple through the App Store and are subject to Apple's terms. All fees are non-refundable except as required by applicable law or at our sole discretion.
- If you purchase a subscription via the App Store, the subscription automatically renews unless canceled before the renewal date. Manage or cancel your subscription through your App Store account settings.
- We do not have access to your App Store purchase history or billing information. For billing issues, contact Apple support.
4. User accounts and data
Some features may require you to create an account or provide information. You are responsible for maintaining the confidentiality of your account and password. You must provide accurate information and keep it updated.
5. User conduct
You agree not to:
- Use the App for any unlawful purpose;
- Interfere with or disrupt the App or servers; or
- Attempt to reverse engineer, decompile, or extract source code from the App except as allowed by applicable law.
6. Content and intellectual property
All content provided in the App (text, graphics, logos, images, audio, software) is owned or licensed by us and protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.
7. Third-party services and links
The App may contain links to third-party websites or services. We do not control and are not responsible for these third parties. Use of third-party services is at your own risk.
8. Privacy
Our Privacy Policy explains how we collect, use and disclose information. By using the App you agree to the collection and use of information explained in the Privacy Policy.
9. Disclaimers
The App is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential or exemplary damages arising from or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability for direct damages will not exceed the greater of (a) the amount you paid us in the past 12 months, or (b) $50.
11. Indemnification
You agree to indemnify and hold harmless FATIH CICEK, its officers, directors, employees and agents from any claims, liabilities, damages, losses or expenses arising from your violation of these Terms or your misuse of the App.
12. Termination
We may suspend or terminate your access to the App at any time for any reason, including breach of these Terms. Upon termination, your right to use the App will end and certain provisions of these Terms that by their nature survive termination will remain in effect.
13. Changes to these Terms
We may modify these Terms from time to time. If we make material changes we will provide notice (for example via the App or email). Continued use of the App after changes indicates acceptance of the updated Terms. The "Effective date" at the top indicates when the Terms were last updated.
14. Governing law and disputes
These Terms are governed by the laws of TURKEY, without regard to conflict of laws rules. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Turkey.
